Jodhpur court summons Salman, Saif in February for poaching case



Bollywood star Salman Khan and three other actors were today summoned by a local court to appear before it on February 4 for chargeframing in the Black Buck poaching case, 14 years after the incident.

The lower court had framed Salman Khan under relevant sections of the Wildlife Act, the Arms Act and the IPC while the others, including actors Saif Ali Khan, Tabbu, Sonali Bendre, Nilam, Dushyant Singh and Dinesh Gawre, were framed under the Wildlife act and the IPC, defence counsel Hastimal Saraswat said.

The accused had then filed a revision petition in the session court which discharged Salman Khan from Section 27 (illegal possession of arms) of the Arms Act and 148 (rioting with deadly weapons) of IPC whereas the others were discharged of section 51 (causing harm to wildlife) of Wildlife Act and both under 147 (punishment for rioting) and 149 (unlawful assembly of persons) of IPC.

Saraswat said the state government then filed a revision petition in the Rajasthan High Court which upheld the decision of the session court in Salman's case whereas added section 149 of IPC against the others, which the session court had dropped.

Two endangered Black Bucks were allegedly poached on the intervening night of 1-2 October, 1998, at Kankani village near Jodhpur during the shooting of the Bollywood movie Hum Saath Saath Hain.

The trial will now commence in the lower court with the revised charges for which the court has summoned all the accused to hear the charges on February 4.

All the accused had last appeared in the lower court on June, 19, 2006 but revision petitions first by the defence and then by the state government had held up the trial.

Salman Khan was convicted and sentenced to 1-year and 5- year prison terms in separate cases of poaching of two Chinkaras at Bhawad and one Black Buck at Ghoda Farm (Mathania) on the intervening night of 26-27 September, 1998 and 28-29 September, 1998 respectively.

Appeals against these sentences, both by Salman Khan and the state government, are pending in the High Court since long.

Katrina meets Salman Khan in Jail!
JODHPUR: Prisoner No 343 in the Central Jail here, Salman Khan, had some special visitors today ~ his girlfriend Bollywood actress Katrina Kaif and other members of his family. Katrina arrived here from Mumbai in the afternoon with Salman's brother Arbaaz and sisters Alvira and Arpita to meet the star, who was arrested yesterday in the wake of a local court rejecting his appeal against a five-year jail term in a poaching case.
Though the jail's visiting hours for the day had ended, superintendent allowed Katrina and the others to meet Salman for about half an hour at around 3 pm. Sources said relatives can meet prisoners only between 9 am and 11 am on Sundays. Katrina and Arbaaz did not speak to reporters who were waiting with hundreds of Salman's fans at the airport here and headed straight for their hotel. Salman (41) was arrested and sent to jail shortly after he arrived here yesterday to surrender.

JODHPUR: The Rajasthan High Court on Monday issued bailable warrants against Bollywood star Salman Khan and seven others after admitting a state government appeal for enhancement of the jail term awarded to him by a local court in Bhavad village poaching case.
They were summoned to appear before it on November 2.The Leave to Appeal (LA) of the government challenged Salman's acquittal under various sections of the Indian Penal Code and Arms Act when he was sentenced in February to a year in prison for killing a chinkara, a species of gazelle, in at Bhavad village in Jodhpur district September 1998.
It also contested the acquittal in the case of actor- comedian Satish Shah and six local residents - Mohammed Hussain, Kuldeep Singh, Mahendra Pal Singh, Mahendra Singh, Dushyant Singh and Yashpal Singh.
Justice H R Panwar of the court's main Bench observed that the facts and circumstances of deemed it a fit case for appeal converted the LA to a Criminal Appeal.
He directed bailable warrants of Rs 5,000 each for the eight accused and summoned them to appear before the court on November 2 and every subsequent hearing.
Chief Judicial Magistrate B K Jain had on February convicted Salman in the case under various sections of the Wildlife Protection Act.
He was, however, acquitted of charges under IPC Sections 143 (punishment for unlawful assembly), 144, unlawful assembly armed with deadly weapon), 148 (rioting armed with deadly weapon) and 201 (causing disappearance of evidence/giving false information) read along with 149 (unlawful assembly) and Section 27 of the Arms Act.

Today the session court in Jodhpur rejected Salman Khan’s appeal against his conviction in the Chinkara hunting case. He was sentenced to five years of rigorous imprisonment along with Rs 25,000 fine by the lower court. He was remanded to Jodhpur jail, and remained there until April 13, 2006. Later he was released on bail. Salman Khan has appealed against the verdict. The case was going on in the Jodhpur court.
Salman Khan was not present in the court today. However he was represented by his advocate accompanied by his sister Alvira Khan. His Counsel prayed for the postponement of the case but court rejected both his Appeal and petition to defer the hearing. The court upheld the judgement of lower court.

Salman Khan has to surrender on Monday. A Non-bailable arrest warrant will be issued against him in case he fails to surrender before the proper authority. But Salman still has a chance of appeal in the High Court of Rajasthan. But salman khan has to surrender before appealing. If the court delays the hearing of the case due to overburden salman khan has to spend atleast few days in the jail. His counsels are trying to secure more time for his surrender.
